Terms of Service

1. Acceptance of Terms

By accessing or using ClawDrift Chat ("the Service"), operated by Goated Ventures LLC ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or through the Service.

2. Description of Service

ClawDrift Chat provides a cloud-hosted AI chat platform that allows users to chat with multiple AI models including Claude, GPT, Gemini, and open source models through one unified interface. The Service is accessible at clawdrift.com.

3. Eligibility

You must be at least 18 years old to use the Service. By using ClawDrift Chat, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To access the Service, you must create an account using Google authentication. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Payments and Billing

ClawDrift Chat offers paid subscription plans. By subscribing, you agree to pay the applicable fees. Payments are processed through Stripe. All fees are non-refundable except as described in our Refund Policy.

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to the Service until the end of your current billing period.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Generate, distribute, or facilitate harmful, abusive, harassing, or illegal content
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Use the Service to build a competing product or service
• Resell, sublicense, or redistribute access to the Service without our prior written consent
• Use automated systems (bots, scrapers) to access the Service beyond its intended use
• Circumvent any usage limits, rate limits, or access restrictions

We reserve the right to suspend or terminate your access for violation of these terms, with or without notice.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Goated Ventures LLC and protected by applicable intellectual property laws. You retain ownership of any content you create using the Service, including your chat conversations and prompts.

AI-generated outputs are provided as-is. We make no claims of ownership over AI-generated content. You are responsible for how you use any content generated through the Service.

8. Third-Party Services

ClawDrift Chat integrates with third-party AI model providers (including Anthropic, OpenAI, Google, and others). Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability, accuracy, or content of third-party AI model outputs.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for evaluating and using AI outputs.

11. Limitation of Liability

To the maximum extent permitted by law, Goated Ventures LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Goated Ventures LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.
